Federal Court Mandates Release of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to answer human smuggling allegations, he was held in immigration detention.
In her order, the court pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Context of the Case
The court proceedings center on conflicting assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in Tennessee.
